Federal High Court Unveils New 2026 Pre-Election Rules, Replaces 2022 Practice Directions

The Federal High Court has introduced new Pre-Election Practice Directions 2026, replacing the 2022 guidelines as part of efforts to ensure the faster, fairer and more efficient handling of pre-election disputes ahead of future elections in Nigeria.

The new rules, officially known as the Federal High Court (Pre-Election) Practice Directions, 2026, were approved by the Chief Judge of the Federal High Court, Hon. Justice John Terhemba Tsoho.

The development was announced in a statement signed by the Director of Information of the Federal High Court of Nigeria, Dr. Catherine Oby Christopher.

According to the court, the Practice Directions are designed to strengthen the management and determination of pre-election cases in accordance with the provisions of the 1999 Constitution of the Federal Republic of Nigeria (as amended), the Electoral Act, 2026, and other relevant laws.

The court explained that the updated guidelines are intended to improve the speed, efficiency and fairness of proceedings involving pre-election matters, which often require expedited hearing due to constitutional timelines.

With the introduction of the new framework, the Federal High Court (Pre-Election) Practice Directions, 2026 have formally repealed the 2022 Practice Directions, making the latest rules the only applicable procedure for all pre-election cases before the Federal High Court.

The court also called on legal practitioners, political parties, litigants and other stakeholders to study and comply with the new Practice Directions to ensure smooth implementation.

It added that copies of the guidelines have been made available to members of the Bar and the general public to provide clarity on the procedures governing pre-election litigation in the Federal High Court.
